Devfolio is owned and operated by NSB Classic PTE LTD. Any other correspondence that is not required by law to be made to the registered office can be made to 2586, Balaji, HAL 2nd Stage, Indiranagar, Bangalore – 560038, Karnataka, India. This domain and all its subdomains are owned and operated by NSB Classic PTE LTD, and all related services therein are also provided by the same.

Relevant parties

• The terms "we", "us", "website", "platform", and "Devfolio" refer to NSB Classic PTE LTD, and its agents and employees;
• The terms "hacker", "you", "user", "hackathon organiser", and "applicant" refer to users of the platform (individuals, and otherwise);
• "Hackathon organiser" shall include individual, institutions, teams, committees, and companies organising hackathons, which have signed a contract, memorandum of understanding, or have any such arrangement with Devfolio, and accordingly list their hackathon on Devfolio;
• All aforementioned parties may be referred to collectively as "parties".

Devfolio as an intermediary

In the absence of any other specific service agreement, memorandum of understanding, or contract, between Devfolio and the user, Devfolio shall only operate as a free-of-cost intermediary. Devfolio shall accordingly let individual users (a) maintain a public profile, (b) explore hackathons, and (c) provide a gateway to apply to participate in such hackathons, on its free platform. With regard to such functionality, Devfolio is a mere intermediary, and as further stated in clause 9, shall not be liable for any cause of action arising therefrom.

Devfolio as a service-provider

Devfolio may enter into other specific written service agreements, memoranda of understanding, contracts, or other such arrangements, commercial or otherwise, with hackathon organizers under which Devfolio may provide certain services including but not limited to access to organizer dashboard, marketing, sponsorship, outreach, organizational support, etc. Only with regard to such parties shall Devfolio be a service provider, and accordingly be responsible for its obligations under the written instrument.

User Eligibility

By using this website, you represent that you are at least eighteen (18) years of age, and otherwise too competent to enter into a valid contract; or if you’re between thirteen (13) and eighteen (18) years old, your educational institution, parent, or guardian has agreed to these terms on your behalf. Children below the age of thirteen (13) are not permitted to use Devfolio. We do not collect user data nor intend to onboard users under the age of 13. If you are under 13, or between 13 and 18 and do not have your parents’ consent, then please do not use Devfolio. If we learn we have collected personal information from a child under 13, we will delete that information as quickly as possible. If you believe that a child under 13 may have provided us personal information, please contact us.

User Obligations and Prohibited Use

The following are the obligations of the users, and any conduct in breach of the same shall deem the use to be prohibited, making such user’s access to the platform liable to be revoked:

• Wherever the website allows you to post or upload data or information, the user shall not publish any material that is false, offensive, harmful, obscene, hateful, pornographic, defamatory, libellous, demeaning, abusive, threatening, or in any other way illegal or infringing upon the legal rights of others, or in violation of the Code of Conduct;
• The user shall not use, or solicit another party to use Devfolio, directly or indirectly, for any purpose which is prohibited by applicable law, rule, regulation or guideline, or, in violation of the Devfolio Code of Conduct;
• The user shall not impersonate any other natural or legal person, and input their identification or contact details, create accounts in their name, or falsely state or misrepresent any association or affiliation with such persons;
• The user shall not wilfully engage in any conduct interfering with, disrupting access to, or breaching security of Devfolio and its website, servers, data, etc., including but not limited to distributed denial-of-service, upload or distribution of corrupted files, viruses and malware.

Payment

All payments on the website are done through Razorpay and are subject to its terms and conditions. Devfolio shall not be liable for any such payment failure.

Rights Reserved

Devfolio reserves with itself the right to:

• Change these terms at any point of time, subject to clause 15,
• Start requiring certain payment for access to the platform, which is currently free, and to subsequently change such amount,
• Restrict certain identifiable class of users from accessing the platform,
• Revoke access of any user of the platform, as under clause 6 or for any other just cause, including but not limited to misconduct and breach of agreement.

Privacy

Data collection and privacy on the website and all its pages shall also be governed by the Devfolio Privacy Policy which can be found here, and is accordingly incorporated herein by reference.

Warranties and Disclaimers

• All Devfolio products, services, documentation, sites, as well as information about Hackathons is on an "as is", and "as available" basis, as provided by Hackathon Organisers.
• Devfolio makes no warranties, express or implied, statutory or otherwise, including inter alia of title, fitness, appropriateness of use, or non-infringement.
• All information on this website is for informational purposes only. We make no representations, warranties, or guarantees, regarding the accuracy of any information on the website; regarding our products and services meeting user expectations and requirements; regarding data being stored in a secure and loss-less manner; and that the use of our products shall be uninterrupted, unencumbered, error-free, and timely.
• We claim no responsibility, and shall not be liable for any action or omission, directly or indirectly attributable to other users, or to the Hackathon organiser, which may be illegal or otherwise deficient.
• If in any jurisdiction certain warranties are statutorily mandated, they shall be deemed be deemed to be valid for the shortest period and maximum extent possible.

External sites

Our website may contain links to other applications or websites ("external sites"), including that of third parties. These links are provided for informational purposes and for convenience only, and unless stated otherwise shall not be interpreted as an endorsement from Devfolio. Such websites and its content shall not be under our control, and we disclaim all liability for any errors, omissions, violation of third-party rights or illegal conduct arising from such external sites.

Governing Law and Dispute Resolution

Use of the website shall be governed by laws of India, and Courts of Bangalore, Karnataka, shall have exclusive jurisdiction on any disputes arising out of this Agreement.

Indemnification

The User agrees to defend, indemnify, and hold NSB Classic PTE LTD, its agents, affiliates, officers, directors, employees, suppliers, and consultants, harmless from any and all claims including third-party claims, liability, damages, and costs (including, but not limited to, attorneys' fees) arising from or related to, (a) their use of the platform, (b) their conduct in violation of these terms, and (c) any other illegal conduct solely by them on their accord.

Miscellaneous

• Entire agreement: This document contain all the terms applicable to the use of the website, and supersedes all other previous undocumented communication and representation and agreements between the parties.
• Severability: In the event of any clause here being declared unenforceable or invalid, then only such clause or part thereof shall be struck, and all the remaining provision shall remain in full force and effect.

Changes

We reserve the right to update this Agreement from time to time. With each change, we shall notify the relevant users by way of a banner on our website, or by an email, based on the significance of the changes. Continuing usage of the website will then imply acceptance of the new terms of the Agreement.
